Resumo

Os primeiros Cursos de Direito no Brasil foram implantados no dia 11 de agosto de 1827. A proposta de ensino jurídico e as suas modificações ao longo da sua história foi justamente uma tentativa de mudanças de paradigmas, na intenção de fugir de um conhecimento meramente dogmático e mumificado em códigos e leis, mas foi, sobretudo, uma proposta de constante renovação, quer pela interpretação, quer pela aprendizagem juridicamente crítica. Normalmente - e a análise histórica oferece elementos que confirmam algumas suspeitas - os fundamentos e os desdobramentos da teologia da libertação, movimento caracterizado pela luta contra a opressão e violação de direitos, foram vinculados à educação, ao pensamento econômico, ao pensamento social, ao pensamento político e filosófico, mas não ao Direito. Assim, o ensino jurídico, na medida em que se pode refletir teoricamente e entender o caráter dogmático de sua concepção inicial, fez o curso de Direito ser entendido hoje como um instrumento de transformação social. Mas, pelas substanciais mudanças no mundo e no estado de consciência da humanidade, os educadores, juristas e teólogos viram-se obrigados a repensar as clássicas categorias de interpretação do processo social e histórico quanto a criar outras novas, numa proposta interdisciplinar. A Teologia, através dos movimentos sociais, também foi responsável por grandes lutas que determinaram novo rumo à história, assim como o Direito, pelo empenho por um Estado democrático, quanto pela rearticulação de um ensino jurídico na direção de novos objetivos sociais, econômicos, políticos, administrativos e culturais, em consonância com as aspirações da sociedade. Neste sentido, tanto a Teologia como o Direito repudiaram a tortura, o cerceamento da liberdade em todas as suas formas, a violação dos direitos fundamentais e a discriminação existente contra negros, índios, mulheres e homossexuais. Nesta linha encontra-se a filiação cristã dos Direitos Humanos, segundo o qual a Igreja busca nas fontes mais profundas da ascese cristã as trilhas que podem conduzir à libertação do povo, e o Direito, através da oposição ao regime autoritário e na busca de um ensino jurídico renovado pensado enquanto instrumento de educação para a cidadania. Percebe-se, a partir dessas análises, uma interlocução ecumênica entre a educação, o direito e a fé. Entende-se que o Direito e a Teologia, assim como a Educação, são hoje componentes indispensáveis no processo de materialização da cidadania. Por tal razão vive-se hoje um novo paradigma, o qual pode ser definido como processo político de construção da cidadania, que tem por objetivo fundamental oportunizar o acesso igualitário ao espaço público como condição de existência e sobrevivência de homens e mulheres enquanto integrantes de uma comunidade. Aliás, não são novidades as profundas dificuldades por que historicamente têm passado as mulheres, especialmente no plano social e, sobretudo, quando visa oferecer uma visão ampla e interdisciplinar sobre os desafios colocados à sociedade contemporânea em apresentar uma concepção de cidadania e direitos humanos sob a perspectiva feminista. Percebe-se então uma quebra de paradigmas que se caracterizou pelo envolvimento das mulheres na discussão sobre a validade das normas e valores que norteiam suas vidas. E assim, o Direito pode se articular com a Teologia e com a Educação, pela sistematização e pelo seu comprometimento com a realidade social.

Abstract

The first programs in Jurisprudence in Brazil were implanted on August 11th of 1827. The proposal for the teaching of Jurisprudence and its modifications throughout its history was specifically an attempt at changing the paradigms in order to get away from the knowledge that was merely dogmatic and mummified in codes and laws and, above all else, it was a proposal for constant renewal, be it through interpretation or through juridically critical learning. Normally - and historical analysis offers elements that confirm some suspicions - the foundations and the developments of the theology of liberation, a movement characterized by the struggle against oppression and violation of human rights, were connected to education, to economic thought, to social thinking, to political and philosophical thinking but not to Jurisprudence. Thus, the teaching of Jurisprudence, as it can be reflected upon theoretically and as the dogmatic character of its initial conception be understood, propitiated that the Jurisprudence program be understood today as an instrument of social transformation. However, because of the substantial changes in the world and in the state of consciousness of humanity, educators, jurists and theologians were forced to rethink the classical categories of interpretation of the social and historical process and create other new ones within an interdisciplinary proposal. Theology, through the social movements, was also responsible for great struggles that determined a new direction for history, just as Jurisprudence, through its work for a democratic State and for the rearticulation of juridical teaching aimed at new social, economic, political, administrative and cultural goals that would be in consonance with the aspirations of society. In this sense, Theology as well as Jurisprudence repudiated torture, the restriction of liberty in all its forms, the violation of basic rights and the discrimination that existed against Blacks, indigenous people, women and homosexuals. In this line one can find the Christian connection to Human Rights according to which the Church seeks within the deepest sources of Christian asceticism the paths that can lead to the liberation of the people and Jurisprudence, through its opposition to the authoritarian regime and in its quest for a renewed juridical teaching that is thought of as an instrument for educating for citizenship. One perceives, from these analyses, an ecumenical dialogue between education, jurisprudence and faith. It is understood that Jurisprudence and Theology as well as Education are, today, indispensable components in the process of materializing citizenship. This is why, today, one lives out a new paradigm that can be defined as a political process of constructing citizenship and has as its basic goal to make possible equal access to the public space as a condition for the existence and survival of men and women as members of a community. By the way, the great difficulties that women have gone through historically, especially on the social level, are not new, and above all, when the goal is to offer a wide and interdisciplinary perspective on the challenges placed before contemporary society to present a concept of citizenship and human rights from a feminist perspective. And thus, Jurisprudence can articulate itself with Theology and with Education through its systematization and through its commitment with the social reality.
